Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Filarr software and its associated services (the "Service"), you agree to be bound by these terms of service (the "Terms"). If you do not accept these Terms, you must not use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. User Account

To access certain features of the Service (including cloud synchronization), you will need to create an account. You are responsible for:

  • Providing accurate and current information during registration
  • Maintaining the confidentiality of your password and recovery key
  • All activity that occurs under your account

Important regarding encryption key: Due to Filarr's zero-knowledge architecture, we cannot recover your password or encryption keys. If you lose both your password and recovery key, your encrypted data will be permanently lost. Filarr cannot under any circumstances be held responsible for data loss resulting from the loss of your credentials.

3. Service Description

Filarr is an open-source file management software under the AGPLv3 license that offers:

  • Local AES-256-GCM encryption of all files
  • Zero-knowledge architecture
  • Encrypted cloud synchronization (paid plans)
  • BYOS (Bring Your Own Storage) mode
  • Secure collaboration features
  • CLI interface

The Service is provided "as is" and "as available". We strive to maintain 99.9% availability, but we do not guarantee uninterrupted operation.

4. Billing and Payment

4.1 Free Plan

The free plan is available indefinitely and includes local encryption, file preview, CLI, and multi-platform support. No credit card is required.

4.2 Paid Plans (Subscriptions)

Monthly paid plans are billed at the beginning of each billing period. You can cancel at any time; cancellation will take effect at the end of the current billing period.

4.3 Perpetual Licenses (BYOS / Enterprise)

Perpetual licenses are a one-time payment that grants you the right to use the software indefinitely, including all future updates. No annual renewal is required.

4.4 Refunds

Monthly subscriptions can be refunded within 14 days of the first payment if you have not substantially used the Service. Perpetual licenses can be refunded within 30 days of purchase. Contact support@filarr.com for any refund requests.

5. Intellectual Property

The Filarr software is distributed under the GNU Affero General Public License version 3 (AGPLv3). You are free to:

  • Use the software for any purpose
  • Study and modify the source code
  • Redistribute copies
  • Distribute modified versions

The "Filarr" trademark, logo, and visual identity remain the property of Filarr and are not covered by the AGPLv3 license. You may not use the Filarr trademark without prior written permission.

Your files and data belong entirely to you. By using the Service, you do not grant us any rights to the content of your files. Due to zero-knowledge architecture, we technically have no access to their content.

6. Acceptable Use

You agree not to use the Service to:

  • Violate applicable laws
  • Infringe on third-party rights
  • Distribute malware or malicious software
  • Attempt to compromise the security of the Service
  • Use the Service for spam or phishing
  • Intentionally overload the Service infrastructure

Note: Due to zero-knowledge architecture, we cannot monitor the content of your files. You are solely responsible for the content you store and share through the Service.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • Filarr shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Filarr's total liability shall not exceed the amount you have paid for the Service in the past 12 months.
  • Filarr is not responsible for data loss resulting from the loss of your password or recovery key, in accordance with the zero-knowledge architecture of the Service.

8. Termination

You can terminate your account at any time by deleting your account in the application settings or by contacting us at support@filarr.com.

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms. In such case, we will notify you by email and give you a reasonable period to export your data.

Upon termination, your encrypted files will be retained for 90 days to allow you to export them, then permanently deleted.

9. Governing Law

These Terms are governed by French law. Any dispute relating to the interpretation or execution of these Terms shall be submitted to the exclusive jurisdiction of the courts of Paris, France, unless otherwise provided by applicable law in your country of residence.

10. Changes to Terms

We may modify these Terms from time to time. Significant changes will be notified by email and/or by a prominent notice on our website at least 30 days before they take effect. If you continue to use the Service after the changes take effect, you accept the modified Terms.
